Policies

 

Prompt & Efficient Service

All orders for ATV parts and lawnmower parts will be shipped within 24 hours, unless some of the items on your order are not in stock.  In that case, the order will be held until the items you have ordered are in stock, which is usually within 2 weeks.  If you prefer to have items in stock immediately shipped, you should select this option at the bottom of the Order Summary page.  In this case, any items that are not in stock at the time your order is processed will be removed from your order and you should reorder these at a later date.

 

Shipping Charges

Shipping charges are calculated by the zone to which the order is shipping to and the weight of the package.

The shipping charge that shows on your order confirmation or order summary page is an estimate ONLY.  This estimated shipping charge may be higher or lower than the actual shipping charges, but should be relatively close.  Exceptions to this rule are items that are extremely heavy or oversized - such as tires, racks, body parts & oil products.  The shipping charges on these items can and will be much greater than the estimated charge.  The exact shipping charges will be emailed to you at the time of shipment of your order.

Shipments to areas other than the continental United States and Canada will be shipped via UPS Air or United States Postal Service.

 

Freight Carriers Used

UPS will be used, by default, to ship all orders, except in cases where very small items with low dollar values are concerned or the shipping method is otherwise stated, such as with fenders and other oversized items.  In these cases, Priority Mail may be used to save freight costs.  If you would prefer to use USPS Priority Mail for shipment of your order, please indicate this wish on your order.

 

Backorders

Items temporarily not in stock will not be backordered.  If you indicate on your order that you wish to ship the order complete, it will be held until all items on the order are in stock.

 

Pricing

Pricing posted on the HyperParts web site are subject to change at any time.  Occasionally, an item posted on the website will not show a price or may show a price of $0.00.  This does not mean the item is free.  To get the price on an item that is not showing a price, you must contact HyperParts via telephone or email.  If you order an item with $0.00 for the pricing, the price of the item will be set on your order at the time of shipment and you will be notified in your shipment confirmation email of the exact total of your order.

 

Sales Tax

Our main shipping warehouse is located in Philadelphia, Mississippi and we are required to collect sales tax on orders shipped to Mississippi and Louisiana. All other areas are considered as "Out of State" and will not incur any sales tax.

 

Satisfaction Guaranteed / Returned Goods Policy

We guarantee your satisfaction with the quality of our parts.  If you are dissatisfied with the quality of our parts, notify us via email at sales@hyperparts.com and we will replace the part or refund your money.  If the parts you received were incorrect due to an error on our part, we will pay the standard ground shipping charges to have the correct part delivered to you and the incorrect part returned to us.  If the part returned is determined by our technical staff to be defective merchandise, you will have the option of a full refund, including all shipping charges or a replacement of the item. Full refunds of shipping charges are only available when an item is determined to be defective and no replacement is requested.

If you need to make a return, notify our sales department at sales@hyperparts.com for a Return Authorization Number (RA#).  There is no restocking fee on returns if the item is returned within thirty (30) days of the invoice date.

Send the items to be returned to our shipping department at:  HyperParts, 212 Lewis Ave., Philadelphia, MS 39350, freight prepaid via United States Postal Service and include a copy of your invoice for proper refunding.

Non-returnable items include items that have been installed, used, or otherwise damaged by improper installation or misuse.  When a non-returnable item is returned, you will be notified via e-mail that the item is non-returnable and you will have the option to have the item shipped back to you at your expense.  If we are not notified within 30 days of your wishes for the item to be returned and a form of payment for the shipping charges provided, the item will be discarded.

 

Insurance

HyperParts offers insurance on all orders, at a rate calculated based on the merchandise total of the order.  This insurance is listed on the Order Summary page and is selected by default.  The option of not paying for the insurance, thus canceling and voiding all protection provided by this insurance is possible by simply unchecking the box labeled 'Include Insurance'.  This insurance covers any damage and/or loss of merchandise during packaging, shipping & delivery of orders up to the point where the order is delivered to the address provided with the order.  Once delivered, the package is the responsibility of the customer and no longer falls under the protection of the insurance.  When insurance has been purchased and an order is lost or damaged, HyperParts has the sole responsibility of replacing the lost/damaged merchandise, including shipping costs via the method chosen by the customer on the original order.  In the case of damaged merchandise, the original carton and damaged merchandise must be kept for possible inspection for no less than three (3) weeks.  If the damaged merchandise cannot be returned when/if requested, the claim will be denied.

 

Shortages and Shipping Damages

All claims must be made within 15 days of the invoice.  In the case of damaged shipments, indicate "damaged" when signing for the package and notify our sales department immediately at sales@hyperparts.com for further instructions.  Keep the original carton and damaged merchandise for possible inspection.

 

Lost Shipments?

Once your order is handed to the carrier you have chosen to ship your order, it is the responsibility of the carrier to care for and deliver your order.  We have no control over what those carriers do to/with your package and are not responsible for anything that happens with them.  However, we will do whatever is in our power to work with the carriers to recover your package or get a reimbursement for your package.  If your order is shipped uninsured and is lost or damaged in transit, HyperParts will not cover the costs of replacing the shipment.

 

What Happens If My Shipment Is Stolen After Delivery?

Once your order is delivered to the shipping address provided with your order, the responsibility of the order is transferred to you, the customer.  If your package is stolen after delivery, you should contact your local police department for instructions on how to proceed.  If you are worried about your order possibly being stolen if dropped off at your address, you should consider requiring a signature for delivery.  You can request this by adding a note in the Notes section of your order.  There is an additional charge for a signature required delivery and you should check with us before ordering for the current price.

 

Express Limited Warranty

HyperParts warrants to you that any goods supplied by HyperParts shall be free from defects in material and workmanship under normal use and service for three (3) months from the date of purchase.

This Express Limited Warranty does not apply where there has been a failure of the goods due to alteration, repair subsequent to the purchase, misuse, improper installation, neglect or accident.

If you believe you have purchased defective goods from HyperParts as described above, notify HyperParts at sales@hyperparts.com, fully informing HyperParts of why you believe the goods are defective.  HyperParts will either request you to return the defective goods to HyperParts for inspection or will rely upon the information you have provided to determine whether the goods are defective as described above.  If any goods are proven to be defective, then HyperParts, at its sole option, will repair or replace the defective goods, refund the purchase price (excluding sales tax and processing costs), or issue a credit toward the purchase of goods from HyperParts in the future.  You are responsible for any and all transportation costs associated with the inspection, repair or replacement of defective goods, and in no event shall you be entitled to damages exceeding the purchase price (excluding sales tax and processing costs) you originally paid for the goods.  Should the warranty provided by the manufacturer of the goods sold to you by HyperParts contain terms and conditions which are more favorable to you than this Express Limited Warranty, you agree that the manufacturer's warranty, and not HyperPart's Express Limited Warranty, shall be your sole and exclusive remedy and warranty.

Except as provided above in the section entitled Express Limited Warranty, HyperParts makes NO other Express or Implied Warranties of any kind, whether as to merchantability or fitness for a particular purpose.

HyperParts shall not be liable for ANY incidental or consequential damages that you allege you may have suffered as a result of the purchase and/or use of goods from HyperParts.  This exclusion of liability for incidental and consequential damages includes, but is not limited to, claims for lost profits, any costs or expenses for labor, transportation, or other expenses incurred by reason of the use or sale of any defective goods.  This Express Limited Warranty gives you specific legal rights and you may have other rights which vary from state to state as some states do not allow the exclusion of warranties and incidental or consequential damages, or the limitation of remedies.
